Moonlight Travel LLC – Terms and Conditions

These Terms & Conditions and Client Travel Agreement (“Terms” and “Agreement”) constitute a legally binding contract between Moonlight Travel LLC (“Moonlight Travel,” “we,” “our,” or “us”) and the undersigned client (“Client,” “you,” or “your”).

By signing or using our services, you acknowledge that you have read, understood, and agreed to these Terms, which govern all travel planning, booking, and related services provided by Moonlight Travel LLC. If you do not agree with any part of these Terms, you must discontinue use of our services immediately.

1. Scope of Services

Moonlight Travel LLC provides travel planning, consultation, booking, and coordination services for individuals and groups. We act as an independent intermediary between Clients and third-party travel suppliers (“Suppliers”) such as airlines, hotels, cruise lines, tour operators, insurance providers, and other service providers.

All bookings are made on your behalf directly with Suppliers. Moonlight Travel LLC does not own, operate, or control any Suppliers or their services and shall not be held responsible for their acts, omissions, errors, or negligence. All travel arrangements are subject to the Supplier’s terms, conditions, and limitations.

2. Client Responsibilities

You agree to:

• Review and verify all travel documents (including names, dates, times, and destinations) immediately upon receipt;
• Ensure that all travelers possess valid passports, visas, vaccination certificates, and other required documentation;
• Comply with all laws, regulations, and Supplier terms related to travel arrangements;
• Provide accurate and complete information to Moonlight Travel LLC and promptly notify us of any changes;
• Obtain and maintain comprehensive travel insurance to cover trip cancellation, interruption, medical emergencies, baggage loss, or other unforeseen events.

Moonlight Travel LLC is not responsible for any issues arising from incomplete, inaccurate, or untimely information, or from a failure to comply with legal or Supplier requirements.

3. Acceptance of Terms

By engaging with our website, communications, or services, you enter into a binding agreement with Moonlight Travel LLC. These Terms apply to all users and Clients.

You affirm that you are at least 18 years of age and possess the legal authority to enter into this Agreement. We reserve the right to modify or update these Terms at any time. Updates are effective upon posting to our website, and your continued use constitutes acceptance of the updated Terms.

4. Use of Website and Services

You are granted a limited, non-exclusive, non-transferable, revocable license to use our website and services for personal, non-commercial purposes.

You agree not to:

• Copy, reproduce, or distribute content without written consent;
• Use the website or services for unlawful or harmful purposes;
• Attempt to gain unauthorized access to any part of the system.

Violations may result in termination of access and legal action.

5. Bookings and Payments

All bookings are subject to availability and Supplier confirmation. Payment terms, schedules, and requirements will be provided in your booking confirmation.

• Moonlight Travel LLC typically transmits payment information directly to Suppliers; charges for travel services are made directly by Suppliers to the Client’s payment method.
• Planning, consultation, or service fees charged directly by Moonlight Travel LLC are disclosed in advance and are nonrefundable unless otherwise stated in writing.
• Failure to provide valid payment information or authorization may result in loss of reservations or increased rates.

5.1 Cancellations, Changes, and Refunds

Supplier policies govern all cancellations, changes, and refunds. Moonlight Travel LLC cannot override these policies.
All cancellation or modification requests must be submitted in writing. Refunds, if applicable, are processed according to Supplier terms.

5.2 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance. Failure to secure coverage is at your own risk.

6. Intellectual Property

All website content, text, graphics, logos, and materials are the property of Moonlight Travel LLC or its content providers and are protected by U.S. and international copyright and trademark laws.

You may not copy, modify, distribute, or create derivative works without prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Moonlight Travel LLC, its officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising out of or in connection with:

• Use or inability to use our services;
• Any act, error, or omission of Suppliers;
• Personal injury, property damage, delays, or other losses related to travel;
• Force majeure events such as natural disasters, pandemics, wars, strikes, or government actions;
• Unauthorized access to your data or transmissions.

Our total liability shall not exceed the amount you paid to Moonlight Travel LLC for the specific service giving rise to the claim.

8. Force Majeure

Moonlight Travel LLC is not liable for delays, cancellations, or failure to perform due to circumstances beyond its control, including but not limited to natural disasters, pandemics, wars, civil unrest, strikes, or government restrictions. Refunds or credits in such cases are subject solely to Supplier policies.

9. Indemnification

You agree to indemnify and hold harmless Moonlight Travel LLC, its affiliates, officers, agents, and employees from any claims, damages, losses, or expenses (including attorney’s fees) arising from your breach of these Terms or misuse of our services.

10. Disclaimer of Warranties

All services are provided on an “as is” and “as available” basis without warranties of any kind. Moonlight Travel LLC does not guarantee uninterrupted, error-free service or the accuracy of third-party information.

11. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Any disputes shall be brought exclusively in the state or federal courts located in Alachua County, Florida. You consent to jurisdiction in these courts and waive objections based on venue.

12. Severability and Waiver

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions will remain in full effect. Failure by Moonlight Travel LLC to enforce any provision does not constitute a waiver of that right.

13. Entire Agreement

This document, together with any written agreements, booking confirmations, and our Privacy Policy, constitutes the entire agreement between you and Moonlight Travel LLC and supersedes all prior agreements or communications. No modification shall be valid unless in writing and signed by both parties.
